The Feyenoord man is seeking to secure Dutch nationality and was backed by the Court of Rotterdam to secure a fast-track ruling.
Dutch minister for Alien Affairs Rita Verdonk lodged an appeal against the ruling, but the Council of State in the Netherlands upheld the initial decision.
Kalou, who was born in Ivory Coast, is now on the cusp of realising his dream to play for the Oranje.
Dutch coach Marco van Basten seems ready to hand him his bow as he welcomed the news.
"I am happy for Salomon with this ruling," said van Basten. "I look forward to working with him."
This ruling increases the possibility of brothers playing against each other at the World Cup for the first time, as Kalou's sibling Bonaventure plays for Ivory Coast.
