Wade Elliott has escaped a Football Association ban following his alleged kick on Blackburn's Pascal Chimbonda during Sunday's Lancashire derby.
The FA asked referee Chris Foy to look over the incident having admitted to missing the confrontation at the time.
However Foy confessed that he could not be sure whether he would have handed the Burnley midfielder a red card at the time having reviewed the video footage.
As FA regulations state that if there is any degree of doubt over a challenge then no action can be taken, Elliott has gone unpunished.
"The referee said that based on the footage he has seen he cannot say for sure he would have shown a red card," an FA spokesperson said.
"Under the rules we are only permitted to take retrospective action if the referee says he would have shown a red card.
"On that basis we will not take any further action against Elliott."
